Managing SARS verification, audits and additional assessments

Remission of penalty applications
- Penalties are imposed for a number of reasons and can cause a financial burden. Some reasons penalties are imposed include late submission of a tax return, understatement of tax liability or errors.
- To have the best chance of reversing penalties, a well prepared and strong argument has to be submitted.
- We will evaluate your penalties and supporting documents and advise if you have grounds for a remission of penalties application and what actions have to be taken prior to submitting an application. If we find reasonable grounds exist to challenge penalties, we will submit an application on your behalf, stating the reasons why we believe the penalties should be reversed.
VDP (Voluntary Disclosure process)
- Historic cases of non-compliance can be corrected with a VDP application, where the taxpayer addresses mistakes and/or omissions on historic returns. This process serves not only to correct mistakes or omissions, but also to limit penalties. Very strict requirements however apply in order to qualify for this application to regulate tax affairs.
- We will review your tax position in detail to identiy whether there non-compliance matters to correct and if you qualify to make use of the VD process. If you do, we will collect the required information and manage the application on your behalf.
Tax Directives
- Tax directives are required in cases where tax must be withheld at a rate other than the prescribed rate. This is the case with lump sum withdrawals, severance benefits, or for commission earners.
- It is important to know the requirements and the facts of the case in order to apply for the correct directive.
- We assist taxpayers by applying for tax directives in cases where it is required to withhold additional tax or to determine if any tax should be withheld, with for instance severance benefits.
SARS Payment arrangement
- When you have a tax debt to pay and you do not have sufficient funds available to make immediate payment in full, a payment arrangement is an option to consider. When the payment arrangement is approved and the taxpayer honours it, it prevents the account for incurring further penalties, however interest may still accumulate.
SARS Payment Compromise
- When you have a substantial tax debt to pay, a payment arrangement is possibly not viable.
- a Payment compromise enables the taxpayer the opportunity to negotiate a settlement amount with SARS in full and final settlement of the tax debt. This will result in the taxpayer paying a portion of the tax debt and SARS writing off the balance.
Tax Clearance
- a Tax clearance certificate may be required for various reasons.
- Prior to applying for a tax clearance, it is important to ensure the taxpayer is in good standing with SARS, meaning all returns have been submitted and tax debts paid.
- We identify areas which could prevent your tax clearance from being issued and assist in correcting all non-compliance in order to obtain tax clearance status.
SARS payment allocations
- In some cases taxpayers are non-compliant only because of a misallocation of payments, whether to the incorrect tax type or incorrect tax period. This could furthermore result in penalties and interest and inaccurate tax statements of account.
- We can assist with identifying misallocations and re-allocating payments in order to reinstate tax compliance and accurate tax statements of account.
